Apostille and legalization of canadian documents

█ ██ ███ █████ APOSTILLE (NEW)

Starting on January 11, 2024, the Apostille Convention will come into effect for Canada, which implies significant modifications in the procedures for the legalization of documents.

This Consulate will no longer legalize Canadian documents to be valid in the Argentine Republic.

All Canadian documents issued after the aforementioned date, as well as all documents not authenticated by Global Affairs Canada, will need to be apostilled by the corresponding authority to be valid in Argentina:

  • Provincial authority (Ontario, Quebec, Alberta, BC and Saskatchewan).
  • GAC (Other provinces)

This includes all notarized documents.

The only exceptions to this new modality are documents authenticated by GAC before January 11th 2024 presented at this Consulate before April 10th 2024, as well as commercial documents (administrative documents directly related to a commercial or customs affairs)

The following documents require an apostille:

  • Documents issued in Canada to be presented in Argentina.
  • Documents issued in Argentina to be presented in Canada.

Important: If the document was signed/certified by a notary that is registered at our office, the document does not need to be authenticated by Global Affairs Canada and you can directly schedule an appointment with us for its legalization.

 

█ ██ ███ █████ COMMERCIAL DOCUMENTS

Commercial documents can be authenticated not only by the Department of Foreign Affairs Trade and Development - Legal Advisory Division, but by the Canadian Chamber of Commerce (Montreal and Ottawa offices):

Note: The signature of the Canadian authority should have been previously registered in the consular office by that authority. Signatures must be in original form and name and title stamped or printed under the signature. Photostat copies must be certified by the same authority that issued the original documents and must bear the proper seal.

 

III. Consular interventions - Goods re-exported to Argentina

     (Goods originating in a country other than the country of export to Argentina)

     (For example: goods of Chinese/Taiwanese origin, exported from Canada to Argentina)

 

1) Certificates of origin

The Canadian exporter must present an original or copy of the certificate of origin (ex. from Chine/Taiwan), issued during the last 360 days. On the back of the certificate of origin (original or copy) the Canadian exporter must sign a sworn statement indicating the following:

a) Full name and address of importer in Argentina.

b) Date and number of commercial invoice by which the Canadian exporter bought the original goods from an exporter in China/Taiwan.

c) Part of the shipment that is being re-exported to Argentina

This declaration will be legalized by our office (Please see requirements  for the legalizations of documents, above.)

 

Note: The legalized document has to be presented to the Argentine customs authorities during the following 180 days.

 

2) Commercial invoices

a) You must present a copy of the original commercial invoice by which the Canadian exporter purchased the goods from the country of origin. This copy will be stamped by our office and will be required by Argentine Customs (See "Visto")

b) Important: Please note that the commercial invoice accompanying the goods, must indicate the Certificate of Origin number and the description of goods must correspond with those detailed on the Certificate of Origin. This invoice does not require intervention by Consular authorities.

 

Note: This information does not aply to goods being exported to Argentina directly from their country of origin or those only in transit (the details of which must be included in the documentation of origin and transport of the goods) through third countries. Such shipments require different documentation and consular intervention depending on the product and country of origin. Please verify requirements with your importer in Argentina.
